You can visit TUSS on weekdays where each room can be rented separately. During weekends and holiday periods, TUSS is rented out as a holiday home.

If your plans deviate from this, do not hesitate to contact us for a tailor-made adjustment.

During weekdays breakfast can be obtained on request. The room rates do not include breakfast. A breakfast package can be ordened during weekends. The order has to be placed at least 4 days before arrival.

For the guestrooms, the check-in takes place between 4 pm and 8 pm and the check-out at the latest at 10:30 am

For the holiday home: Rent on a weekend basis: check-in on Friday from 4 pm to 8 pm, check-out on Sunday before 3 pm; Weekly rental: check-in on Friday from 5 p.m. to 8 p.m., check-out on Friday at 3 pm

TERMS AND CONDITIONS TERMS AND CONDITIONS Article 1 - General These general terms and conditions regulate the (legal) relationship between BV C&H Invest, established at Stijn Streuvelslaan 11, 8501 Heule and with company number 0765.797.677, being the operator of the residence Tuss (hereinafter the lessor), and the tenant(s) of a guest room in the residence Tuss, or the tenant(s) of the residence Tuss as a holiday home (hereinafter both are referred to as “tenant(s)”. The residence Tuss is located at Stijn Streuvelslaan 19, 8501 Heule. The contact person of the residence Tuss is Mrs. Lieselot De Wulf, who can always be reached by telephone on +32 470 91 55 92. The lessor is not a travel organization or travel agent. These general terms and conditions apply to all offers and quotations from, agreements with, deliveries and services of the lessor. These general terms and conditions can only be deviated from in writing (with the consent of both parties). Article 2 – Conclusion of the agreement A booking of a guest room of the residence Tuss or of the holiday home Tuss can only be done electronically via the Tuss website (www.tuss.be). Other forms of booking (eg by e-mail) are not accepted. An agreement between the lessor and the tenant(s) is only concluded after confirmation by e-mail by the lessor of an electronic booking by the tenant(s) of a guest room in the residence Tuss or of the holiday home Tuss. The tenant must be at least 21 years old and have a permanent residence. He will present his proof of identity for this purpose on first request. Article 3 – Description of location and inventory for holiday home On arrival (before the keys are handed over), the parties draw up an incoming inventory (including inventory of all goods present). On departure (and before acceptance of the keys), an outgoing inventory (including inventory of all goods present) is drawn up by both parties The location descriptions are always contradictory by signing by both parties. The parties agree that the handing over of the keys, in whatever form, and the execution of the outgoing inventory of the premises cannot constitute a partial or complete discharge. Article 4 – Prices, payment and guarantee The prices stated on the website at the time of booking apply. The prices of the guest room(s) always include the use of the room within the agreed arrival and departure times, the gas, electricity and water consumption within normal limits, the use of household linen and the cleaning of the room after departure. Are not included in the price: tourist tax, breakfast and gas, electricity and water consumption outside the normal limits. The prices of the holiday home always include the use of the holiday home within the agreed arrival and departure times, gas, electricity and water consumption within normal limits and the use of household linen, a limited supply of toilet paper, washing up liquid and dishwasher tablets, coffee and non-sparkling water. Are not included in the price: tourist tax, breakfast, gas, electricity and water consumption outside the normal limits and the cleaning of the holiday home after departure. The lessor expressly reserves the right to increase the agreed prices if, after the conclusion of the agreement, one or more cost price factors (including but not limited to the prices of raw materials and energy, labor costs, an increase in certain government levies, or changes in insurance premiums, or changes in legislation or regulations, which have an impact on the costs to be borne by the lessor) are subject to an increase, even if this is due to foreseeable circumstances. In case of booking a guest room of the residence Tuss, the full price of the room must be paid at the time of booking. In case of booking the stay Tuss as a holiday home, an advance of 750.00 euros must be paid at the time of booking. The booking process cannot be continued/finalized without immediate payment of the price of the room or the deposit of the holiday home. The agreement cannot be concluded without this payment. The balance of the rental price of the holiday home, a deposit of 500.00 euros, the tourist tax and the cleaning costs must then be paid within a week of the invitation by e-mail to the account number BE65 0019 0545 8296 of C&H Invest. In the absence of timely payment, the lessor can dissolve the agreement without prior intervention of the court by means of a simple written notification (by e-mail). In that case, the advance remains acquired. If the booking of the holiday home is made within 10 days prior to the desired rental period, the full rental price of the holiday home, a deposit of 500.00 euros, the tourist tax and the cleaning costs must be paid immediately. Failing this, the booking process cannot be continued/finalized and the agreement cannot be concluded. The cleaning costs, which are charged, relate to the cleaning up of the holiday home that has been left behind, as is expected from the tenant, cf. the house rules. If the holiday home is left in a different condition, additional costs will be charged. The deposit for the holiday home will be refunded to the tenant at the latest 30 days after departure to the account from which the deposit was deposited. Any damage to the holiday home and/or the movable property present and/or the purchase price of any movable property that has disappeared and/or the gas, electricity and water consumption that is outside normal limits and any extra costs for cleaning will be charged to the deposit will be deducted. Article 5 – Essential binding house rules The tenant(s) is/are obliged to comply with the TUSS house rules. The holiday home is suitable for a maximum of 14 people and it is therefore strictly forbidden to exceed this number. Children under the age of 6 are not allowed in the TUSS residence, taking into account that there is a natural swimming pool with a depth of 1.6 m. Pets are also not allowed. The tenant(s) must respect the property, the environment and the neighbors and may not cause any nuisance at any time. Parties or bachelor parties are not allowed. Smoking is not allowed in the residence TUSS. Smoking is allowed outside the TUSS residence, but the tenant(s) must remove the cigarette butts at all times before leaving the TUSS residence. The tenant(s) is obliged to use and maintain the holiday home at all times (keep in clean condition) with due care. Damage must be reported immediately by telephone to the contact person of the residence Tuss. It is not allowed to move the furniture. A BBQ and fire bowl are provided. In case of extreme drought, their use may be prohibited to protect the surrounding nature. Wood can be provided on request and subject to payment of an additional cost. It is forbidden to use glass in the garden. Glass can only be used on the terrace. To consume drinks in the garden, plastic glasses are provided in the kitchen cabinets. Drinking is prohibited in the natural swimming pool. At TUSS the waste is sorted. All PMD goes into the blue bags, cardboard and paper are stored separately and the rest of the waste goes into a general garbage bag. All waste is kept in the underground garage (accessible via the ramp next to the terrace) at the agreed place. At least 2 days before arrival at the holiday home, the complete and final guest list (first name + surname + age) of the holiday home must be provided for insurance reasons. It is not allowed to deviate from this list, without the written permission of the lessor. At the end of the stay, the tenant must return the holiday home in the same condition as at the start. To this end, the tenant must, among other things, leave the holiday home spotlessly clean, empty the dishwasher and store the household goods properly in the cupboards. All rubbish should be placed in the rubbish bags provided for this purpose in the underground garage (accessible via the ramp next to the terrace). Also, all empty glass bottles should be collected in the garage in the curver boxes provided there. If the accommodation is not left as agreed, the landlord has the right to charge additional cleaning costs at €48/hour (excluding VAT). These costs will then be deducted from the deposit. Article 6 – Arrival and departure times In case a guest room is booked, the tenant can occupy the room from 4 pm (with key handover until 8 pm). Departure is scheduled for 10:30 am at the latest. In case the holiday home is booked for a weekend, the tenant can occupy the property from Friday 4 pm (with key handover until 8 pm). Departure is at the latest on Sunday 3 pm. In case the holiday home is rented on a weekly basis, the arrival is possible from Friday 4 pm (with key handover until 8 pm) and the departure takes place on Friday at 3 PM. The parties may agree in writing other dates and times for arrival and departure. In any case, the tenant(s) will inform the contact person of the stay TUSS by telephone at least 2 hours in advance of the arrival and departure time. Article 7 - Transfer or sublease The agreement is personal to the tenant(s), so he/she may in no way transfer the agreement to a third party without written permission from the landlord. Subletting, in whole or in part, temporarily and/or free of charge is also not permitted. Article 8 – Cancellation The tenant is entitled to cancel the booking at any time, subject to payment of a cancellation fee. Failure to appear on the day of arrival is considered a cancellation. The cancellation fee is as follows for the holiday home: • between 7 and 0 day(s) before arrival: 100% payment of the rental price • between 21 and 8 days before arrival: 50% payment of the rent • between 22 and 49 days before arrival: €500 • for 49 days before arrival: 50 € administrative costs The cancellation fee is as follows for the guest rooms: • between 7 and 0 day(s) before arrival: 100% payment of the rental price • between 30 and 8 days before arrival: 50% payment of the rent • more than 30 days before arrival: 25 € administrative costs In case of cancellation due to force majeure, no refunds are possible, here we will look for another suitable date together. The tenant must check for any cancellation insurance. Article 9 - Dissolution In the event of a serious breach of contract by one of the parties with regard to the agreement, the other party may dissolve the agreement without prior court intervention by means of a simple written notification to the other party (by e-mail). Can be regarded as serious breach of contract: • causing serious damage to the accommodation (and/or the household effects) • non-compliance with the essential house rules • failure to comply with payment obligations on time In the event of dissolution at the expense of the tenant(s), all amounts already paid remain acquired for the landlord. Article 10 – Complaints procedure If the customer has any complaints, he can contact the contact person of TUSS Article 11 – Liability The tenant(s) is liable for damage caused by him and any fellow travelers (including all persons whom he lets into the house), even if this is only established after his departure. The tenant is obliged to have a civil liability insurance that covers all damage to the residence TUSS and the furniture/goods present. The operator of TUSS is not liable for loss, theft or damage of/to the goods of the tenant(s) and all other fellow guests, nor for any injury or accident suffered by the tenant and all other fellow guests during their stay in TUSS. The building and the natural swimming pool are always used under your own responsibility. The operator of TUSS is not liable or responsible for the non-performance or delay in the performance of its obligations under the agreement (including any disruption, change or impediment of the stay) that is due to force majeure and/or the consequence is of unforeseen or insurmountable events caused by third parties or the government, such as interruptions in the supply of utility companies, failure of technical installations, road works, local events, … The operator of TUSS can only be held liable for damage attributable to his own gross error/negligence. The liability of the operator of TUSS for damage will always be limited to a maximum of direct damage and to the value of the price of the booking. Article 12 – Applicable law and competent court All agreements to which these general terms and conditions apply, as well as all other agreements resulting therefrom, are exclusively governed by Belgian law. Any dispute about the validity, interpretation or application of all agreements to which these general terms and conditions apply, falls under the jurisdiction of the court competent for the location of the residence TUSS. The nullity of a provision or part of a provision under the agreement will in no way affect the validity of the remaining part of the provision or the rest of the provisions and clauses of the agreement. The parties will mutually adjust the void (partial) provision to a valid (partial) provision, whereby the original intention of the parties takes precedence.
