TERMS AND CONDITIONS

 

1. Applicable of the general terms and conditions

 

1.1. The general terms and conditions apply to all offers, quotations and agreements with the delivery and services of guesthouse Hof Moye Tyt

 

1.2. The general conditions are:

 

- on the one hand exclusively applicable to legal relationships between the guesthouse and consumers

 

- on the other hand only applicable between the guesthouse and companies or resp. persons acting in the exercise of their profession.

 

2. Offers, prices and rates

 

2.1. The offers and prices on the website may differ from the effective price of the booking. The guesthouse reserves the right to change prices and / or charge a surcharge. The customer / guest will be informed of the price applicable at that time, which is then also binding.

 

2.2. All statements on the website of Hof Moye Tyt (www.moyetyt.be) are deemed to have been provided in good faith and are always made with regard to interim adjustments. New rates take effect as soon as they are published on the website. Hof Moye Tyt is not bound by obvious errors on its website!

 

2.3. The stated prices are always exclusive of the costs of cancellation or travel insurance or any other costs. The customer / guest must provide this himself / herself if he / she wishes.

 

3. Conclusion and content of an agreement

 

3.1. An agreement between Hof Moye Tyt and the customer / guest is established by a confirmation by e-mail of a reservation. The customer / guest who books must be of age. If there is availability, the booking will be confirmed within 72 hours. The guesthouse reserves the right to refuse a booking without giving any reason.

 

3.2. After booking, the customer / guest will receive a confirmation of the booking / rental agreement by email, which serves as proof of the agreement. If no email address or mobile number is available, the booking confirmation will be sent in writing by post. The shipping costs are charged for this.

 

3.3. The reservation confirmations sent by the guesthouse contain all relevant information for the stay at Hof Moye Tyt. In the interest of a good booking and to avoid misunderstandings, the customer / guest undertakes to immediately check the correctness and completeness of the data. Incompleteness or inaccuracies will be reported to the guesthouse by the customer / guest within 24 hours of receipt of the booking confirmation. If no such notification is made within the set period, the customer / guest is not entitled to invoke the incompleteness or inaccuracy of the reservation confirmation or agreement.

 

4. Payment

 

4.1. Payment of the booking to the guesthouse is done:

 

- upon arrival in cash or payconiq

 

- before arrival by transferring the amount due to account number BE75 9730 2056 5751, stating the name and dates of the stay or the reservation number indicated by the owner. If payment is not made in cash, the payment must be made before the start of the stay, whereby the transfer is verifiably realized at the time of the start of the stay.

 

4.2. In case of late bookings (within 72 hours before arrival) payment can only be made in cash upon arrival.

 

4.3. Payment of an advance of 50% on the total price must be made within 7 calendar days after receipt of the reservation confirmation. An advance does not have to be paid for late bookings (within 72 hours before arrival).

 

4.4. Payment of a deposit of 200 € is mandatory with every reservation. The deposit is always included in the total amount when booking. The guesthouse undertakes to refund the deposit to his account within 7 calendar days after departure of the customer / guest, after deduction of any damage costs.

 

4.5. Dispute of an invoice must be made known by registered letter within 8 calendar days after receipt of the invoice. All invoices are payable in cash and without discount in Wilskerke. In the event of full or partial non-payment on the due date, i.e. on arrival, the invoice amount will be increased by operation of law and without notice of default with an interest of 12% per year from the due date, with a minimum of € 125.00 and with a maximum of € 1,860.00 , even if a term of payment is granted and without infringing the possibilities in art. 1244 B.W

 

4.6. In any case and without prejudice to the above, failure to fulfill the payment obligation will result in the service and the agreement being suspended by Hof Moye Tyt. All outstanding balances are immediately due and payable. In case of dispute, only the courts of the jurisdiction to which the municipality of Middelkerke belongs.

 

5. Cancellation and modification

 

5.1. The customer / guest is entitled to cancel a reservation in writing, free of charge, within a reflection period of 7 calendar days. After this cooling-off period, the right to cancel free of charge expires.

 

5.2. After the completion of the activities described in 5.1. set term, the customer / guest is only entitled to a written cancellation against payment of the under a to e.m. d stated cancellation costs

 

a) If the cancellation falls between the legal cooling-off period and 28 calendar days before arrival, an amount of 25% of the total amount is due. The guesthouse has the right to deduct this from the advance or total amount already paid

 

b) If the cancellation occurs between 28 and 7 calendar days before arrival, an amount of 50% of the total amount is due. The guesthouse has the right to deduct this from the advance or total amount already paid.

 

c) If the cancellation occurs between 7 and 0 calendar days before arrival, an amount of 100% of the total amount is due. The guesthouse has the right to deduct this from the total amount already paid.

 

d) In the event of a no-show, the entire total amount will be charged.

 

e) Any monies or advances already paid will be set off against the severance payment to be paid.

 

5.3. Canceling a reservation by the main guest also counts as cancellation at the expense of the fellow guest (s)

 

5.4. Cancellation by the guesthouse:

 

The guesthouse must make the customer / guest a change proposal in the form of an alternative offer within 48 hours (2 working days) after serious circumstances have occurred.

 

If the customer / guest does not wish to accept this alternative offer, the guesthouse will refund the money already paid by the customer / guest. Compelling circumstances fall under force majeure (see point 7).

 

This obligation lapses if the cause of the change can be attributed to the customer / guest.

 

5.5. The guesthouse charges € 10.00 administration costs for reservations that have to be changed at the request of the customer / guest.

 

6. Rights and obligations of the customer / guest on site during the stay in the accommodation

 

6.1. In addition to these terms and conditions and the agreement, local law is always applicable on site. Unless otherwise provided by law, the internal regulations apply. The customer / guest and his fellow guests must comply with the house rules, which can be found on the website and the information folder in the guesthouse.

 

6.2. The customer / guest must contact the owners of the guesthouse in advance, either by telephone or by e-mail in case:

 

- they wish to book for a period that deviates from the normal rental periods (being weekend 2 nights, midweek or week from Friday to Friday). Agreements can be made about this in mutual consultation and according to availability.

 

- they wish to arrive or depart outside the normal arrival and departure times (ie arrival between 4 pm and 6 pm, departure by 11 am). Agreements can be made about this in mutual consultation.

 

6.3. The customer / guest and fellow guests must behave as a good user of the guesthouse and the entire accommodation. The guest (s) must use the accommodation in accordance with the agreements in the house rules.

 

6.4. There is a total smoking ban in the guesthouse and breakfast room.

 

6.5. The guest is legally liable for damage caused by him or his fellow guests to the guest house, the garden and the associated items and furniture. A claim must be reported immediately by the guest to the owner. Repair or replacement costs are to be reimbursed by the guest to the owner. These costs will be charged when the deposit is returned. If the damage costs are higher than the deposit paid by the guest, the insurance of the guest (or his fellow guests) will be held liable for this.

 

7. Force majeure

 

In case of force majeure, both permanent and temporary, the guesthouse is entitled to dissolve the agreement in whole or in part or to suspend it temporarily without the guest being able to claim compliance or compensation.

 

Force majeure includes, but is not limited to: failures, boycotts, disruptions in the energy circuit, in traffic or transport, government measures, scarcity of raw materials, natural disasters, as well as all circumstances, extraordinary weather conditions, death or illness of the owner or relatives, unannounced sale and / or commissioning of the accommodation by the owner, etc., as a result of which full or partial compliance with the agreement cannot be required by the guesthouse in all reasonableness and fairness.

 

8. Liability

 

8.1 Hof Moye Tyt cannot be held liable for damage suffered by the guest (s) or third parties as a result of the stay in the accommodation. The guest indemnifies Hof Moye Tyt against claims in this regard. Hof Moye Tyt is not liable for malfunctions in and around the accommodation such as malfunctions or failure of power, water supplies, technical installations, construction work not or not announced on time and changes to access or main roads.

 

8.2. The guest is legally liable for damage caused by him or his fellow guests to the guesthouse, the garden and the associated items or furniture. A claim must be reported immediately by the guest to the owner. Repairs or replacement costs are to be reimbursed by the guest to the owner. These costs will be charged when the deposit paid by the guest is returned. If the damage costs are higher than the deposit paid by the guest, the insurance of the guest (or his fellow guests) will be held liable for this.

 

8.3. Hof Moye Tyt is not liable for theft, loss and damage of any kind, during or as a result of the stay.

 

8.4. Hof Moye Tyt is not liable or responsible for any accidents during the use of the accommodation and garden during the stay of the guest and his fellow guests.

 

8.5. Hof Moye Tyt can only be held liable for damage due to gross negligence or negligence on the part of the guesthouse.

 

8.6. Without prejudice to the enumeration in points 8.1 to 8.5, the liability of Hof Moye Tyt, if and insofar as the guesthouse is legally liable for any reason with regard to the user agreement, is always limited to direct damage and any form of consequential damage is excluded. The liability of Hof Moye Tyt is furthermore always limited to the maximum amount that the insurer of the guesthouse will pay out in such a case.

 

9. Privacy

 

Hof Moye Tyt will treat the personal data provided or made known to it by the guest confidentially in accordance with the GDPR legislation.

 

10. Final provision

 

10.1 Unless otherwise provided by rules of private international law, these terms and conditions are exclusively governed by Belgian law. Non-Belgian guests are deemed to agree with the general terms and conditions. In case of dispute, only the courts of the jurisdiction to which the municipality of Middelkerke belongs.

 

10.2. All disputes arising from the user agreement or these terms and conditions will be settled in the first instance by the competent court in Belgium, insofar as the rules of private international law do not provide otherwise.

 

10.3. Neither party can transfer its rights and obligations to the third party unless otherwise provided in these terms and conditions.

 

10.4. If and insofar as any provision in the user agreement and these terms and conditions should prove to be invalid, the other terms and conditions will remain in force and the invalid article will be deemed to have been converted in such a way that it is brought in accordance with the apparent intentions of the parties.
